1. Agreement & scope

These Terms of Service ("Terms") form a binding agreement between you ("you", "customer") and KRIEGER GLOBAL SLU, trading as Eternas Beauty ("we", "us", "Eternas Beauty"), governing your use of the website eternas.beauty and the purchase of any product or service offered through it.

By browsing the site, creating an account or placing an order, you accept these Terms. If you do not accept them, please do not use the site.

2. Eligibility & account

• You must be at least 18 years of age and have legal capacity to enter contracts in your country of residence.
• You may purchase as a guest or by creating an account.
• If you create an account, you are responsible for the accuracy of the information you provide and for keeping your login credentials confidential.
• You agree to notify us immediately of any unauthorized use of your account.
• We may refuse, restrict or close an account at our reasonable discretion, particularly in cases of suspected fraud, abuse, or repeated policy breaches.

3. Products & descriptions

We make every reasonable effort to display product images, descriptions, specifications and prices accurately. However, due to differences in monitor calibration, lighting and screen settings, colors and finishes may appear slightly different on your device than in real life.

Product specifications (wavelengths, frequencies, power outputs, materials) are stated based on independent laboratory testing. Minor variations within standard manufacturing tolerances are normal and do not constitute defects.

We reserve the right to modify, discontinue or replace products, descriptions, prices and offers at any time without prior notice. Modifications do not affect orders already placed and confirmed.

4. Orders, pricing & payment

Placing an order

Each order you submit is an offer to purchase. The contract is formed only when we send you an order confirmation email and process payment successfully. We reserve the right to refuse or cancel any order, including but not limited to: suspected fraudulent activity, pricing errors, product unavailability, or delivery restrictions.

Prices & currency

Prices are displayed in your local currency where available, including applicable VAT for EU destinations. For destinations outside the EU, prices are exclusive of import duties and taxes (see our Shipping Policy).

Pricing errors

If a price displayed on our website is obviously incorrect (for example, due to a typographical or system error), we may cancel the order even after confirmation. Where this happens, we will notify you immediately and offer either a full refund or the correct price.

Payment methods

We accept major credit and debit cards (Visa, Mastercard, American Express), PayPal, Apple Pay, Google Pay, and other payment methods displayed at checkout. Payment is processed in real time through our PCI-DSS compliant processors. We do not store full card details.

Invoicing

An electronic invoice is automatically issued for every order and emailed to you. For VAT-registered businesses requiring a corrected invoice with company VAT details, please contact support@eternas.beauty.com within 14 days of the order.

5. Shipping & delivery

Shipping rates, delivery times, available destinations and exclusions are detailed in our Shipping Policy, which forms an integral part of these Terms.

Risk of loss and title to the products pass to you upon delivery to the carrier (in technical terms: "Incoterms DAP" — Delivered at Place). We remain responsible for arranging carriage and resolving lost or damaged shipments per the Shipping Policy.

6. Returns, refunds & warranty

All return rights, hygiene conditions, refund procedures and the 365-day satisfaction guarantee are set out in our Returns & Refunds Policy, which forms part of these Terms. Statutory rights under EU consumer protection law (including the 14-day right of withdrawal) apply to EU customers and are detailed in that policy.

Each device is covered by a 1-year manufacturer warranty against defects in materials and workmanship from the date of delivery. The warranty does not cover damage caused by misuse, accidents, unauthorized modification, or normal wear and tear.

7. Acceptable use of the site

You agree to use the website only for lawful purposes and in a manner that does not infringe the rights of, or restrict the use of, others. You may not:

• Attempt to access areas, systems or data that are not intended for you;
• Interfere with the operation of the site, its security, or with other users' access;
• Use bots, scrapers, automated tools or any technology to extract data from the site at scale;
• Place fraudulent or abusive orders, including using stolen payment credentials or fake addresses;
• Use the site to transmit malware, viruses, spam or illegal content;
• Engage in harassment or threatening behavior against our team, suppliers or other customers.

Violation of these rules may result in immediate suspension of your account, cancellation of pending orders, and where appropriate, referral to law enforcement.

8. Intellectual property

All content on the Eternas Beauty website — including the brand name "Eternas™", logos, product names, designs, photographs, videos, copy, illustrations, code, layouts, and the overall look and feel — is the exclusive property of KRIEGER GLOBAL SLU or its licensors, and is protected by international copyright, trademark and other intellectual property laws.

You may not copy, reproduce, modify, distribute, sell, license, publicly display or create derivative works of any part of our content without our prior written permission, except for personal, non-commercial browsing.

The "Eternas" trademark is officially registered. Unauthorized commercial use of our brand assets may result in legal action.

9. Reviews & user-generated content

If you submit a product review, photo, video, social media post or other content related to Eternas Beauty ("UGC"):

• You confirm that you are the author and have the right to share the content;
• You grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, display and adapt your UGC for marketing, customer education and brand-building purposes, including on our website, social media and advertising;
• You agree that your UGC must be honest, lawful, free of offensive language and not infringe third-party rights;
• We may moderate, edit or refuse to publish UGC that does not meet our community guidelines.

10. Disclaimers & medical notice

The website and its content are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all express and implied warranties, including merchantability, fitness for a particular purpose and non-infringement — except where such disclaimer is prohibited by mandatory consumer protection law.

11. Limitation of liability

To the maximum extent permitted by applicable law:

• Our total liability arising out of or in connection with any order is limited to the amount you paid for that order.
• We are not liable for indirect, incidental, consequential, special or punitive damages, including loss of profits, loss of business, loss of data, or loss of opportunity.
• Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be limited or excluded by law.

Statutory consumer rights — including those granted by EU Directive 2011/83/EU on consumer rights — are not affected by these limitations.

12. Indemnification

You agree to defend, indemnify and hold harmless KRIEGER GLOBAL SLU, its directors, employees and agents from any claim, loss, damage, liability or expense (including reasonable legal fees) arising out of: (a) your breach of these Terms; (b) your misuse of our products or services; (c) your violation of any law or of any third party's rights; (d) any content you submit through our site.

13. Suspension & termination

We may suspend or terminate your access to the website or your account at our reasonable discretion, with or without notice, if:

• You breach these Terms or any of our policies;
• We detect fraudulent activity, chargebacks, or abuse of our refund policy;
• We are required to do so by law, regulation or court order;
• Continuing to do business with you would expose Eternas Beauty, its team or other customers to material risk.

Termination does not affect rights and obligations accrued before the termination date.

14. Governing law & dispute resolution

These Terms are governed by the laws of Spain, without regard to its conflict-of-law principles. Mandatory consumer protection rules of your country of residence — to the extent they grant you greater protection — continue to apply.

If a dispute arises, we encourage you to contact us first at support@eternas.beauty.com. We will respond in good faith to attempt an amicable resolution.

If no agreement is reached, EU consumers may use the European Commission's Online Dispute Resolution platform. Alternatively, disputes may be brought before the competent courts of Murcia, Spain, or the courts of the consumer's country of residence, at the consumer's option.

15. Changes to these terms

We may update these Terms from time to time to reflect changes in our services, technology, applicable law, or commercial practice. Substantive changes will be announced on the website at least 14 days before they take effect, and where reasonable, by email to registered users. Orders placed before the change takes effect remain governed by the Terms in force at the time of order.
